Fresch Creative & Melauria Ink – Commercial License Agreement

Number of Users (or Seats)

The number of permitted users (or seats) is the number declared and paid for at the time of purchase.

Commercial Use: Physical and Digital End Products

  • Limit: 5,000 combined total physical and digital end products.
  • Use in a website, application, or video game is prohibited.
  • Any commercial use must:
  1. Be significantly different from the original Licensed Asset.
  2. Require time, effort, and skill to produce.
  3. Not derive its primary value from the Licensed Asset itself.
  4. Resale or sublicensing of the Licensed Asset in source-file form or otherwise competitive with the Licensed Asset is prohibited.

Commercial Use: Advertisements and Promotion

  • Unlimited physical (printed) advertisements within a local market.
  • Use with one business social-media account is permitted.

Commercial Use: Broadcast Content

  • Up to 500,000 lifetime viewers.

Important Legal Notice

By completing the purchase process and/or checking “agree,” you acknowledge that you have read and accepted this License Agreement, including Section 9 (Important General Legal Provisions).
Fresch Creative & Melauria Ink offer different license types; the one selected at the time of purchase applies to your use of the Licensed Asset.

Key Terms

This License Agreement defines your non-exclusive, limited copyright license for digital content (“Licensed Asset”) made available by Fresch Creative & Melauria Ink via their official stores or approved third-party marketplaces (e.g., Etsy, Creative Fabrica).

The Licensed Asset item number and a link to this License Agreement will be emailed to you. Please retain this for your records.

Summary of Permissions and Restrictions

✅ Permitted Uses

  • Physical products: Up to 5,000 combined physical + digital items for sale.
  • Packaging: Boxes, labels, stickers, etc.
  • Digital products: Static designs or static website elements.
  • Print or digital publications: Magazines, e-books, scrapbooks, etc.
  • Social media: One personal or company account (depending on use).
  • Advertisements: Unlimited impressions for digital or local print use.
  • Broadcasts / Streams: Up to 500,000 lifetime viewers.

❌ Prohibited Uses

  • Print-on-demand or “create-on-demand” services.
  • National or global print advertising.
  • App, software, or video game development.
  • Trademarking or claiming copyright ownership of the Licensed Asset.
  • Use in illegal, defamatory, or offensive material.
  • Resale or sharing of the Licensed Asset in editable / source form.

Legal Details

All Licensed Assets are protected under Canadian and international copyright law.
You are purchasing a limited license, not ownership of the underlying design.

Violations of this license may result in immediate termination of your rights to use the asset.

All disputes shall be governed by the laws of Ontario, Canada.
